MINUTES OF THE PUBLIC MEETING OF MARCH 28TH, 2006
HANSON TOWN HALL, LIBERTY ST., HANSON, MA


Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5. by Philip Lindquist, Chairman, in Meeting Room A on the top floor at the Town Hall.

A vote of the March 14th, 2006 minutes was postponed until the April 11th, 2006 meeting.


Public Hearings

7:45 PM  Notice of Intent for the construction of a Police Station with parking, utilities, drainage and other site improvements at the vacant lot between 795 & 781 Main Street, Assessors Map 34, Lot 10 for the Town of Hanson represented by PLACES Site Consultants, Inc., 694 Main St., Suite 3, Holden, MA  01520  (New Hearing)  (DEP #SE175-0492)

David Harris read the Public Hearing Notice and the abutters were verified.  Mr. Lindquist explained that David Harris, who is a direct abutter had disclosed in writing to the appointing authority that he had no financial interest in the proposed Police Station project.  The Board of Selectman concluded  there was no conflict of interest and granted an exemption so that he could fully participate in the hearing.  Bill Murray of PLACES Site Consultants, Inc. made the presentation for the proposed Police Station, parking, drainage and septic system.   The Police Station, parking lot and septic system were designed outside of the 100-foot buffer zone.   A 50-foot buffer zone to an Isolated Land Subject to Flooding is to be maintained as protected under the Hanson Wetlands By-Law.   It was determined that a ponding area adjacent to and within the Matthews property does not meet the criteria under the Massachusetts Wetlands Protection Act.  Ms. Delaney asked Tom Sexton of Mainstream Engineering, the Town’s consultant, if he agreed with the stormwater calculations as written.  Mr. Sexton responded that he agreed with the theoretical 10-year design storm event which had been applied.  However, if a 100-year storm calculation had been used, the limit of ponding possibly could be higher.   Phil Lindquist read the abutters list.  Those present were:

Mr. Lindquist wanted to know if the depression in question was a vernal pool.  Ms. Delaney answered that it hadn’t been observed during the Spring when most indicators are apparent. Mr. Sexton commented that in the Operation and Maintenance Plan, a condition had been provided in that if it was a vernal pool, an interceptor drain would be adjusted accordingly.   Ms. Delaney stated that the O & M Plan should also include an Evaluation Checklist and Inspection Schedule using Best Management Practices.  She added that a National Pollutant Discharge Elimination System (NPDES) Permit was required as well.

8:15 PM  Notice of Intent for the construction of a 15,200 s.f. contractor’s building, parking, driveway, storm drainage system and related utilities and grading within the buffer zone of a Bordering Vegetated Wetland at 36 Industrial Blvd., Map 59, Lot 17-2 for Glenn Valley represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (DEP #SE175-0494)  (New Hearing)

David Harris read the Public Hearing Notice and the abutters were verified.  Bob Crowell of Land Planning made the presentation for an industrial building.  A Request for Variance from the 95-foot setback for a commercial/industrial project was submitted as a small portion of the driveway was designed in this area.  Ms. Delaney suggested approval as Coneco Engineering had already reviewed the Stormwater Management Plan for the Appeals Board.  Glenn Valley, the applicant, explained that the building was going to be used for storage of heating and A/C equipment.  Ms. Delaney recommended a revised O & M Plan to include an Inspection Schedule and Evaluation Checklist as well as a NPDES Permit.  Mr. Lindquist read the abutters list.  None were present.

8:30 PM  Continued Request for Determination of Applicability for the installation of a septic tank, pump chamber, utilities, filling and grading at 75 Big Rock Lane, Assessors Map 64, Lot 1 for William Patton represented by Alan Dias, P.O. Box 314, Monponsett, MA  02350  

Alan Dias presented a revised plan.  The septic had been redesigned with a reduced mound.  Ms. Delaney asked why the proposed haybale was so extensive.  Mr. Dias said he could eliminate some of them.  Ms. Delaney also asked about runoff from the site.  Mr. Dias suggested that he could use a Marafi or similar fabric in the storm drain to prevent siltation from entering the drainage system.

8:45 PM Continued Notice of Intent for the construction of a single family dwelling with associated septic, driveway and utilities within 100 feet of an isolated wetland at Oak St., Map 70, Lot 2B-1 for Stephan Webby represented by Webby Engineering, Inc.   (Local Filing #06-01)  

Joe Webby presented a revised plan.  The edge of the isolated wetland had been re-flagged by Sharon LePorte and the house and driveway had been relocated as requested at the previous meeting.  The haybales were at the 50-foot setback and shown as the limit of work.   Two swales were added as well.  Mr. Lindquist read the abutters list.  Those present were:

Judy Goodwin, 304 Lakeside Road – She asked if the wetland was a certified vernal pool.

Ms. Delaney answered no, that the area was degraded and used as a dumping ground in the past.  She suggested that a condition is included that the area will be cleaned up in August after the breeding season is over and also requested permission to certify the area as a vernal pool.  Mr. Webby had no problem with that.

9:15 PM Continued Notice of Intent for a revised proposal for the construction of eight (8) single-bedroom condominium units with parking and septic within 100 feet of a bordering vegetated wetland at 1139 Main St., Assessor’s Map 43, Lots 36A & B and 36.  A portion of the construction falls within the 100-foot inner riparian zone. Proposal includes clean up of existing construction debris and soils on Lot 36.   Applicant:   Demco Enterprises, Inc., 31 Perkins Street, Bridgewater, MA  02324 represented by Land Planning, Inc.. Orders of Conditions/Determinations of Applicability

Determination of Applicability to construct a driveway and install utilities with associated grading and landscaping at Lot 6, Nina Drive, Map 27, Lot 3-6 for Elko Construction Co. – signed

Enforcement Orders

Enforcement Order for Dan Rosman for 558 East Washington St. (DEP #SE175-378)
Ms. Delaney explained that Mr. Rosman had not responded to the E.O..  Subsequently, it was determined that he had sold the property without recording the Orders of Conditions.   Because Mr. Rosman is still the responsible party, Ms. Delaney will determine the appropriate action to take and update the Commission.  

Discussion Items

Environmental Monitor Report and ISEC’s from Marchionda & Associates for Stonebridge Commons (DEP #SE175-366 & SE175-396) (Report Date 3/13/06)

Ms. Delaney had inspected.  They are still working on the replication, but there is an issue with connectivity.  They need permission from the Commission to dig a channel in the area.  Janine said they were working near a vernal pool.  She asked them to stop until the breeding season is over.  Otherwise, it is a very clean site.

Memo from Meredith Marini, Executive Assistant regarding request for release from Chapter 61A of 116 acres of land on Elm Street owned by Ellen Stillman.

96 Bay State Circle – Ms. Delaney had noted at an erosion control inspection that an above-ground swimming pool and decking had been built directly over wetlands.  She will draft a letter to the owner.
